Requesting an internal review

What is an internal review?

An internal review involves a decision or action of the Office of the Independent Regulator (OIR) being reviewed after the person involved disagrees with the outcome.

What can be reviewed?

Only specific decisions or actions can be internally reviewed.

They are:

  • to give notice to produce a document or information in situations related to an organisation’s compliance with the Child and Youth Safe Standards, as well as the Reportable Conduct Scheme
  • to give notice to comply with the Child or Youth Safe Standards or the Universal Principle for Aboriginal Cultural Safety
  • a finding made by the Independent Regulator at the end of an own-motion Reportable Conduct Scheme investigation
  • to give notice to an entity regulator (which is an agency other than the OIR) to investigate a Reportable Conduct Scheme matter

Who can request an internal review?

  • a worker of an in-scope organisation
  • an in-scope organisation
  • an entity regulator.

How would I apply for an internal review?

A request for an internal review must be made in writing (via email or post) and addressed to the person who made the decision.

A request must be made:

  • no later than the deadline set by the notice to produce
  • within 28 (calendar) days of the written finding of an own-motion Reportable Conduct Scheme investigation being sent to the appropriate organisation or person.

The request should ideally make it clear why you think the decision or action is wrong and give us much supporting information as possible.

The OIR will endeavour to respond within 30 (or if required, 21 by law) days, however this may be subject to negotiation between parties.
